This litigation concerns whether Liquidia Technologies, Inc.\u2019s proposed treprostinil inhalation powder, Yutrepia<sup>TM<\/sup>, would infringe the \u2019066 and \u2019793 patents.\n<\/p>\n<p>\nThe Court determined that Liquidia would induce infringement of various claims of the \u2019793 patent by marketing Yutrepia. The \u2018793 patent relates to a method of administering treprostinil via inhalation. The Court also concluded that Liquidia failed to prove that any claim of the \u2019793 patent at issue is invalid.\n<\/p>\n<p>\nAs a result of the Court\u2019s decision, United Therapeutics expects the Court to enter an injunction barring the U.S. Food and Drug Administration from granting final approval for Yutrepia until expiration of the \u2019793 patent, May 14, 2027, as required by 35 U.S.C. \u00a7 271(e)(4)(A).\n<\/p>\n<p>\nThe Court also determined that Yutrepia<sup> <\/sup>would infringe several claims of the \u2019066 patent, but found those claims to be invalid. The \u2018066 patent relates to a method of making treprostinil, the active pharmaceutical ingredient in both Tyvaso<sup>\u00ae<\/sup> (treprostinil) Inhalation Solution and Tyvaso DPI\u2122 (treprostinil) Inhalation Powder.\n<\/p>\n<p>\nBoth parties have the right to appeal. United Therapeutics is evaluating the Court\u2019s opinion and next steps, including the potential for appealing the Court\u2019s decisions on the \u2019066 patent.\n<\/p>\n<p>\n\u201cWe\u2019re pleased with the Court\u2019s decision on the \u2019793 patent, and our legal team is evaluating options for the \u2019066 patent,\u201d said Shaun Snader, Vice President and Associate General Counsel \u2013 IP and Litigation at United Therapeutics. \u201cToday\u2019s decision vindicates our claims that Yutrepia is an infringing product, and we will continue to vigorously defend our intellectual property.\u201d\n<\/p>\n<p>\nThe Patent Trial and Appeal Board (<b>PTAB<\/b>) of the U.S. Patent and Trademark Office recently issued a final written decision in an <i>inter partes<\/i> review (<b>IPR<\/b>) of the \u2019793 patent initiated by Liquidia. That final written decision held that the \u2019793 patent is invalid. United Therapeutics has requested rehearing regarding that decision, and if the PTAB does not reverse itself, the company will appeal. The \u2019793 patent remains valid during the pendency of all appeals. United Therapeutics expects any IPR appeal process will likely take at least a year.
